news and appeals involving the excesses of the electricity
sector against the people and the Amazon rivers. Against
life, anyway.
Foi em vão. Mesmo desestimulada
pelos rumos tomados pelos enfrentamentos socioambientais, dei-me outra chance
ao escrever mais este texto. Talvez eu não tenha completado meu carma ou não
tenha esgotado meus argumentos para provar as ilegalidades dos processos de
licenciamento de grandes obras. Ou talvez eu ainda acredite que temos chances
de reverter este modelo de desenvolvimento ultrapassado e predatório que estão
impondo ao Brasil.
It was in
vain. Although discouraged by the direction
taken by social and
environmental engagements, this gave me another
chance to write more on this article. Maybe I have not
completed my karma, or it has been exhausted or my
arguments do not prove the illegality of the licensing
process for major projects. Or maybe I still believe
that we are likely to reverse this development
models that are outdated and predatory and being imposed
in Brazil.
Sinceramente, não sei. É um
comichão danado quando me deparo com fatos e decisões de autoridades ou
empresas que subestimam a inteligência do brasileiro. Até aí, nenhuma novidade,
pois estão sempre nos tratando como seres abjetos e imersos na fatuidade ou na
alienação induzida.
I honestly do
not know. It's a darn itching when I come
across facts and decisions of authorities
or companies who underestimate the intelligence of the
Brazilian people. So far, nothing new has come up. They are
always treating us as
beings immersed in abject and fatuity or induced the
sale.
Quis o destino que chegasse às
minhas mãos mais um documento que me encheu de verdadeira ira. Mesmo ficando à
margem, tentando fazer ouvidos moucos, tenho acompanhado todos os movimentos
dos hidropredadores e genocidas de plantão para tratorar (literalmente) o rio
Tapajós e a vida que flui dele. Baluarte da inocência dos ecossistemas da
Amazônia. Obra prima que outrora inatingível na sua pureza, ainda encarna
o último bastião de um tempo perdido. O Tapajós, hoje, representa o derradeiro
peão do tabuleiro de xadrez da Amazônia. Acompanhar sua queda anunciada é um
martírio.
As fate would have it, I came
across a document that made me very angry. Even staying on the

Há muito tempo que a Presidência
da República, o Ministério de Minas e Energia (MME), a Agência Nacional de
Energia Elétrica (Aneel), a Empresa de Pesquisa Energética (EPE) e o Ibama
estabeleceram entre si um cronograma para destruir o rio Tapajós e pôr em risco
os povos e a floresta. Planejam um complexo com cinco hidrelétricas. Em janeiro
de 2012 contaram com a ajuda da presidente Dilma Rousseff que
assinou a famosa Medida
Provisória (MP)nº 558 que fez alterações nos limites dos
Parques Nacionais da Amazônia, dos Campos Amazônicos e Mapinguari, das
Florestas Nacionais de Itaituba I, Itaituba II e do Crepori e da Área de
Proteção Ambiental do Tapajós. A MP liberou, entre outras, a região onde
as UCs seriam empecilhos à construção das hidrelétricas na bacia do rio
Tapajós.
For a long time that the
Presidency of the Republic, the Ministry of Mines and
Energy (MME), the National Agency of Electrical Energy (ANEEL),
the Energy Research Company (EPE) and IBAMA established
between themselves a schedule to destroy the Tapajos

minada. Como se isso não bastasse, outro fato rompeu definitivamente
minha já alquebrada vontade de continuar desconsiderando o óbvio. Explico.

EIA/RIMA da UHE São Luiz do Tapajós
The Terms of Reference for
the EIA / RIMA UHE São Luiz do Tapajós
Os projetos hidrelétricos têm
obedecido a um padrão no processo de licenciamento. O empreendedor protocola no
órgão licenciador um pedido para emissão de licença prévia depois que os
estudos de viabilidade técnica e econômica são aceitos pela EPE. No caso do
projeto da UHE São Luiz do Tapajós, compete ao Ibama o aceite do EIA/RIMA, o
processo de análise dos estudos ambientais e a concessão ou não da licença
ambiental. Ao protocolar o pedido de licença, o empreendedor recebe do Ibama um
Termo de Referência (TR) para orientar o conteudo do EIA/RIMA.
Hydroelectric projects have
obeyed a standard in the licensing process. The
entrepreneur must adhere to licensing
agency protocols in his request for the issuance
of an advance license after the technical feasibility and
cost are accepted by EPE. In the case
of the HPP project São Luiz
do Tapajós, IBAMA has
accepted the responsibility of the EIS/ EIR, the process

Fiquei absolutamente petrificada
ao descobrir que desta feita, o TR tinha sido elaborado pelo próprio
empreendedor que (auto)determinou aquilo que deveria constar do EIA/RIMA.
Incrível! Só falta agora ele mesmo se conceder a LP. Para provar o que estou
falando extraí uma imagem do respectivo sistema do Ibama em que se lê
claramente:
I was
absolutely petrified to discover that this time,

Bingo. Resolvi parar por aqui,
só para ficar nas usinas planejadas e em construção no Pará. E para minha
surpresa, todos os TRs foram elaborados pelo próprio Ibama e não pelos
principais interessados em fazer um EIA/RIMA, digamos, conveniente.

O TR para elaboração do EIA/RIMA

do EIA/RIMA da UHE Teles Pires, por exemplo, em construção na sub-bacia do rio
Tapajós, o Ibama especifiou outros estudos e documentos que integram o
processo licenciamento ambiental. São referentes a obtenção de outorga da
água, Avaliação do Potencial Malarígeno (APM), Prospecção de material
arqueológico, paleontológico ou de interesse histórico, a espeleologia e ainda
os estudos etnoecológicos de comunidades indígenas, quilombolas e de
assentamentos humanos, conforme a pertinência.
The preparation of TORs
for EIA / RIMA UHE São Luiz do Tapajós contains

locais dos dois projetos são, se não idênticas, muito semelhantes. O rio
Tapajós nasce da confluência do rio Teles Pires com o rio Juruena e com eles
integra uma só grande bacia hidrográfica. Como aceitar que os TRs que orientam
os dois estudos, um elaborado pelo Ibama e outro pelo empreendedor, sejam tão discrepantes?
The
physical locations of the two designs are, if not
identical, very similar. TheTapajós River is born
of the confluence with the rio Teles Pires and

projeto. Não é mais profundo que uma lâmina d'água.
On indigenous lands
that sufferfrom the
impacts of the hydroelectric dam São Luiz doTapajós upstream, the
mention in the TORs is laughable. They call only
the identification, mapping and description of current
vulnerabilities of indigenous communities arising from project
implementation. This represents a very shallow evaluation of the
situation. In itself it is less than profound.
O TR da UHE Teles Pires, ao
contrário, pede o estudo que relaciona as áreas de abrangência do projeto e a
sua influência nos meios físico e biótico em relação às Terras indígenas. Nele
há um ítem específico sobre populações indígenas e as diretrizes da Funai,
quanto à temática indígena e sua quantificação.
The TORs
for HPP Teles Pires, on the other hand, addresses in
their study the areas covered by the project and
its influence on physical and biotic media in relation
to Indigenous lands. In it there is a specific item on
Indigenous populations and the guidelines
of Funai, regarding Indigenous issues and its
quantification.
Quero reforçar que isso tudo não
implica, de maneira alguma, que se o TR da UHE São Luiz do Tapajós fosse feito
pelo Ibama, o empreendimento deixaria de ser danoso, destruidor ou de ameaçar
os direitos dos povos indígenas e das populações tradicionais. Na verdade, o
interesse é mostrar como, no Brasil, se distorce as leis e se adequa procedimentos
para viabilizar mega-projetos criados para satisfazer interesses escusos.
I want to stress that all
this does not imply in any way, that if the TORs
of HPP São Luiz do Tapajós were done by IBAMA, that
the venture would be harmful, destructive or threaten the
rights of Indigenous peoples and traditional populations. In
fact, the interest here is to show how, in
Brazil, it distorts the laws
and procedures are designed to enable mega-projects to
satisfy vested interests.
