O MTST realizou na noite de sexta-feira, dia 2 de março de 2012, duas ocupações simultâneas, em diferentes regiões da Grande São Paulo: uma no município de Embu e outra no município de Santo André, no ABC. As ocupações, que levam o nome de “Novo Pinheirinho”, são uma resposta ao recente despejo violento da comunidade do Pinheirinho (São José dos Campos) e também uma ação necessária para a conquista de moradia por aqueles que há tempos vem lutando por uma vida mais digna.

Ocupação do MTST realizada em 2 de março, por 800 famílias sem teto
Localização: Parque Pirajuçara, Embu, terreno conhecido como “Roque Valente”. Pode-se entrar no local pela Rua Indianópolis, próximo a campo de futebol.
Área total: 433.800 m2
Histórico do Terreno
O terreno ocupado pelo MTST é conhecido como “Roque Valente” (nome de seu antigo proprietário). Trata-se de uma área desocupada entre os Bairros Parque Pirajuçara e o Jardim Santa Tereza, no município de Embu, com o tamanho de 433.800 m2. Seu atual proprietário é a CDHU – Companhia de Desenvolvimento Habitacional Urbano – órgão do Governo do Estado que, em 1998, adquiriu o terreno para implementar um conjunto habitacional para a população de baixa renda. O projeto elaborado pela CDHU previa a manutenção da vegetação local, transformando-a em Parque Ecológico, e o aproveitamento da área desmatada (150 mil m2) para a construção de 1200 unidades habitacionais. O projeto contava ainda com a construção de um centro esportivo, um centro educacional e outro centro de cultura ambiental, destinados à comunidade.
Tal projeto nunca saiu do papel visto que, em 2006, um grupo de ambientalistas contrários à proposta das moradias populares conseguiu uma liminar do Ministério Público proibindo construções no local.
A situação atual do terreno, que até hoje permanece abandonado e portanto sem nenhum uso social, é a seguinte: dois terços da área são classificados como APP – Área de Proteção Permanente – e devem ser preservados. Um terço dela, no entanto, não é classificada no plano diretor da cidade como área de preservação.
A proposta do MTST é a de conciliar as necessidades de preservação ambiental com a de criar novas habitações nesses bairros cujo déficit habitacional é reconhecidamente alarmante.
Os fatos que levaram à ocupação:
Grande déficit habitacional do Embu, em torno de 9 mil moradias (dados de 2011), e o constante descaso do poder público leva a população organizada em movimentos sociais a fazer valer seus direitos.
O terreno “Roque Valente” não tem uso social nenhum – nem Parque, nem habitação – em uma área densamente povoada e carente de moradias no município. A área ocupada é da CDHU, portanto, deveria ser destinada à construção de moradias. Tal destinação nunca se realizou pois existe uma disputa jurídica há tempos que entrava o início das obras. Antes da ocupação tentou-se, de todas as formas institucionais, resolver o problema.
Entre 2008 e 2009 aproximadamente 900 famílias de sem teto foram despejadas três vezes de terrenos que haviam ocupado: a primeira vez no Jardim Tomé e duas vezes no Jardim Nossa Senhora de Fátima. Apenas uma pequena parte delas (300 famílias) recebeu ajuda do programa bolsa-aluguel enquanto aguardavam que suas casa definitivas fossem construídas. Três anos depois de o Governo Estadual ter assinado os termos de compromisso, sequer o terreno para a construção das moradias novas foi definido. O convênio do bolsa-aluguel acaba em julho de 2012. Novamente, as famílias ficarão sem ter para onde ir.
Isso mostra que o problema da preservação ambiental não é resolvido com o abandono e má conservação do terreno ocupado. Faz-se necessária uma política pública de manutenção do espaço pois, tal como ele está hoje, a tendência é que se deteriore rapidamente.
A título de exemplo, lembramos a história do terreno ocupado pelo MTST em 2008, no bairro de Jardim Tomé. Durante todo o período em que o acampamento do MTST ficou por lá, as inúmeras árvores da área foram preservadas. Depois do despejo, o mesmo terreno foi vendido e passou a funcionar como galpão industrial. Todas as árvores foram rapidamente retiradas, num ato claro de desrespeito ao meio-ambiente.
A construção de habitações populares e, ao mesmo tempo, a conservação da mata pela população local, empenhada e mobilizada em cuidar de sua vizinhança, é a melhor solução para garantir o bom uso deste terreno público, hoje completamente abandonado. A regulamentação do terreno como área de ocupação mista, feita pela prefeitura recentemente, permite a implementação desta solução que concilia a necessidade de preservar o meio ambiente e de criar novas moradias na região.
O que queremos:
- Implementação imediata do Projeto Habitacional na área, por meio de uma parceria entre o MTST e a Caixa Econômica , via programa Minha casa, Minha vida.

Ocupação do MTST em 2 de março de 2012, por 450 famílias sem teto.
Bairro: Jardim Santa Cristina, Santo André
Área do terreno: aproximadamente 50 m2
Fatos que levaram a ocupação:
- O déficit habitacional de Santo André é de 25 mil moradias, um dos mais altos da região metropolitana de São Paulo. Esse número, aliado à falta de soluções apontadas pelo poder público, levam os moradores que não tem onde morar a se organizar e reivindicar seus direitos.
- O MTST realizou, em 2010, uma ocupação no bairro Cidade São Jorge, em Santo André, que contava com 700 famílias dando origem ao acampamento “Nova Palestina”. Como o terreno era da Prefeitura do município, ela rapidamente entrou com o pedido de reintegração de posse e a comunidade foi despejada sob a alegação de que já havia projeto para construir um galpão industrial, no mesmo local. A obra, supostamente, começaria um mês depois da desocupação. Contudo, até hoje o terreno permanece vazio e abandonado.
Embora apenas 30 famílias tenham recebido o bolsa aluguel da prefeitura., iniciou-se uma importante negociação com a Prefeitura, que resultou na assinatura de um protocolo de intenções para a construção de 400 habitações no jardim Santa Cristina. Mais uma vez, o compromisso não saiu do papel perdendo-se na trama burocrática da Caixa Econômica Federal e da CDHU. As 700 famílias que sofreram o despejo no acampamento “Nova palestina”continuam até hoje sem ter onde morar. Depois de muitas lutas na cidade, de vários esforços de negociação – todos fracassados – a ocupação surge como a única opção para fazer valer o acordo já estabelecido e ampliá-lo para que beneficie mais famílias no município que cada vez mais sofre com a especulação imobiliária.
O que queremos:
1. Dar continuidade à construção das 400 moradias já negociadas com a Prefeitura de Santo André em 2009.
2. Construção de mais moradias no novo terreno.
