Brasília – O Ministério Público Federal (MPF) nos estados do Pará e de Mato Grosso e o Ministério Público Estadual de Mato Grosso pediram na Justiça a suspensão do licenciamento e das obras da Usina Hidrelétrica Teles Pires, que está sendo construída no rio de mesmo nome, entre os dois estados.

Na ação, o Ministério Público pede que a Justiça determine ao Instituto Brasileiro do Meio Ambiente e dos Recursos Naturais Renováveis (Ibama) e à Empresa de Pesquisa Energética (EPE) que o licenciamento e as obras da usina sejam suspensos imediatamente. Segundo o órgão, os povos Kayabi, Munduruku e Apiaká, que serão afetados pelo projeto, não foram ouvidos, como determina a Constituição Federal e convenções internacionais das quais o Brasil é signatário, como a Convenção 169 da Organização Internacional do Trabalho.

As três primeiras ações do MP já haviam apontado falhas no processo de licenciamento, como estudos ambientais incompletos, problemas nas audiências públicas e a não realização de ações obrigatórias que poderiam reduzir os impactos da obra.

A licença de instalação foi concedida pelo Ibama em 19 de agosto do ano passado. Em dezembro de 2010, o leilão da usina só foi realizado depois que a Advocacia-Geral da União conseguiu derrubar uma liminar que suspendia a licitação, concedida pela Justiça Federal no Pará a pedido do MPF.

Brasilia - The Federal Public Ministry (MPF) in the states of Para and Mato Grosso and the Public Prosecutors of Mato Grosso asked in court to suspend the license and the works of the Teles Pires hydroelectric plant, which is being built on the river of the same name, between the two states.

The first three actions of the MP had already pointed out flaws in the licensing process due to incomplete environmental studies, public hearings on the problems and failure to carry out mandatory actions that could reduce the impacts of the project.

The installation license was granted by IBAMA on August 19th of last year. In December 2010, the auction of the plant was made only after the Attorney General's Office was able to overturn a preliminary injunction suspending the tender issued by the Federal Court in Para at the request of the MPF.
