A entrada da AGU no processo, porém, se dá momentos depois de o juiz Federal Carlos Alberto Antônio Júnior se declarar incompetente para julgar o caso, contrariando decisão da juíza plantonista. Para ele, não está demonstrado claramente o interesse da União no caso, logo, não seria da alçada federal. Com isso, a liminar suspendendo a reintegração perde efeito e os milhares de moradores do Pinheirinho voltam a ser alvo da ação da polícia, que pode ocorrer a qualquer momento.


Desde então, o seguinte aconteceu
A Justiça suspendeu por 15 dias a ordem de desocupação da área do Pinheirinho, em São José dos Campos. A decisão foi deferida nesta quarta-feira, dia 18, pelo juiz titular da 18ª Vara Cível de São Paulo Luiz Bethoven Giffoni Ferreira.

The court reinstated the injunction against the eviction Pinheirinho area in Sao Josedos Campos for 15 days. The decision was deferred on Wednesday, March 18, the judge of the18th Civil Court of São Paulo Ferreira Luiz Beethoven Giffoni.
