Durante uma ação de desocupação de indígenas Terena de uma fazenda, na tarde deste sábado (18), no município de Sidrolândia, Estado do Mato Grosso do Sul, o delegado da Polícia Federal, Alcídio de Souza Araújo, apreendeu um computador do jornalista do Conselho Indigenista Missionário (Cimi) Ruy Sposati, que, assim como outros profissionais de comunicação, cobria a ação. Segundo o jornalista, Araújo se negou a protocolar a apreensão ou a dar qualquer justificativa legal do ato e, em nenhum momento, apresentou qualquer ordem da Justiça ou de órgão competente para busca e apreensão de equipamentos, que seguiriam em posse da PF. Um gravador também teria sido apreendido.

Ruy conta que chegou à ocupação por volta das 13h acompanhando uma comitiva de observadores externos composta por Cimi, Comissão Permanente de Assuntos Indígenas da Ordem dos Advogados do Brasil, Comissão Pastoral da Terra, Centro de Defesa dos Direitos Humanos do Mato Grosso do Sul e outras instituições, que foram ao local para verificar possíveis violações de direitos humanos.

Ainda segundo o jornalista, por volta das 16h30, a Policia Federal chegou para participar das negociações pela saída dos indígenas da fazenda, objeto de uma liminar de reintegração de posse concedida pela Justiça. Ruy e outros profissionais da imprensa se aproximaram para acompanhar a conversa, permanecendo a uma certa distância para fotografar o local.

Neste momento, o oficial de Justiça, que cumpria a ordem de despejo, apontou Ruy ao delegado como sendo fotógrafo do Cimi. “Eu estava me afastando quando fui alcançado pelo delegado Araújo, que pediu minha identificação e iniciou a revista da minha mochila”, afirmou. Sem justificativa, o delegado tomou seu computador e gravador. De nada teria adiantando o protesto do jornalista, que se identificou como membro da imprensa no exercício legal de sua profissão. “Ele só dizia que atuava no estado há vários anos e nunca tinha ouvido falar do Cimi, como se isso fosse alguma justificativa para pegar minhas coisas”, afirma Ruy.

Sobre o fato de o jornalista ser membro de uma organização social, é preciso reforçar que o Cimi não é réu nem consta de nenhum inquérito que justifique apreensão de equipamentos.

Advogados consultados por este blog afirmam que a ação de Araújo é ilegal porque não havia ordem judicial de busca e apreensão, o jornalista não cometeu nenhum ato que justificasse interrogatório e não há nada no Código de Processo Penal que embase seu comportamento. Ao contrário, o artigo 3º, item J, da lei 4.898 (Direito de Representação e o processo de Responsabilidade Administrativa Civil e Penal), afirma que constitui abuso de autoridade “qualquer atentado aos direitos e garantias legais assegurados ao exercício profissional”.

At this time, the bailiff, who was overseeing the eviction, the sheriff singled Ruy out as the photographer for Cimi. "I was moving away when Araujo approached me and asked for my ID and started the documents in my bag," he said. Without justification, the officer took his computer and recorder. Nothing would protest ahead of the journalist, who identified himself as a member of the press in the lawful exercise of their profession."He just said he worked in the state for several years and had never heard of CIMI, as if this was some justification to take my stuff," says Ruy.

The fact was that the journalist was a member of a social organization, and that nothing could justify the seizure of his equipment.

Lawyers consulted by this blog claim that the action by Araújo was illegal because there was no warrant for search and seizure, the journalist has not committed any act justifying interrogation and there is nothing in the Code of Criminal Procedure to base their behavior on. Rather, Article 3, Item J, Law 4898 (Law Representation and the process of Administrative Responsibility Civil and Criminal), states that the actions by the bailiff constituted an abuse of authority "any attack on the rights and legal safeguards provided to the professional."
