Já se completaram seis anos do conflito entre a polícia e o Primeiro Comando da Capital (PCC) que matou mais de 600 pessoas. Débora da Silva Maria é mãe de Edson Rogério, assassinado por policiais no dia 15 de maio de 2006. Ela se tornou, depois disso, militante dos direitos humanos. Em entrevista à Carta Maior, Débora conta como é sua batalha ao lado do movimento que ajudou a criar chamado Mães de Maio e sua luta pelo fim das mortes pelo Estado.


São Paulo - A polícia militar brasileira está na mira da ONU. Na semana passada, seu Conselho de Direitos Humanos aprovou várias recomendações como parte do relatório elaborado pelo Grupo de Trabalho sobre o Exame Periódico Universal (EPU) do Brasil. Uma delas é pela extinção da polícia militar. A posição da entidade foi publicada dois dias depois de mais um caso alarmante em São Paulo. Na última segunda-feira (28), policiais militares mataram seis pessoas, segundo eles, suspeitos de tentar resgatar um presidiário membro do Primeiro Comando da Capital. Testemunhas afirmam que houveram execuções e tortura, colocando mais uma vez para toda a sociedade, a urgência do debate entorno da segurança pública. Infelizmente, casos como esse não são esporádicos. A segurança no estado de São Paulo é marcada pela impunidade desses policiais (como apontou matéria recente da Carta Maior).
Sao Paulo - The Brazilian military police are in the sights of the UN. The "Crimes of May" is an emblematic case. Have you completed six years of conflict between police and First Capital Command (PCC) which killed over 600 people. Deborah Smith Mary is the mother of Roger Edson, killed by police on May 15, 2006. After that she became a human rights activist. Fighting also for memory, truth and justice, because, she said, "we live in a continued dictatorship." In this interview, Deborah tells how his battle is next to the movement he helped create called the Mothers of May and his struggle to end the killings by the state.

Na época a Secretaria de Segurança Pública deu uma estatística de 493 mortos. Mas as pesquisas da ONG Conectas deu 532 mortos e a de Harvard ["São Paulo sob achaque", publicado em maio de 2011, pela ONG Justiça Global e pela Clínica Internacional de Direitos Humanos da Universidade de Harvard] deu mais de 600 pessoas. Isso porque há pessoas desaparecidas, o que é de praxe. Descobrimos também que chacinas com mais de uma vítima são registradas como se tivesse uma vítima só. At the time the Department of Public Safety gave a statistic of 493 dead. CM - Você conhece casos de familiares que não tiveram acesso aos corpos?

Nós achamos que eles estão espalhados por vários cemitérios. Até o momento, nem a Secretaria de Direitos Humanos deu uma resposta definitiva, e as famílias vivem neste desespero.

E depois do sequestro do enteado do Marcos Camacho, o Marcola, houve uma vingança, segundo o que a mídia divulgou. No relatório “São Paulo sob achaque” vimos que havia corrupção por trás dos Crimes de Maio. Aí se iniciaram as rebeliões como um aviso. Mas nós temos conhecimento que nem todos os crimes cometidos contra agentes do Estado foram praticados pelo crime organizado, e sim pelos próprios companheiros de farda.

Essa mãe fez as próprias investigações com apoio do Departamento de Homicídios e de Proteção à Pessoa (DHPP) e soubemos que em julho vai ter o julgamento pra ver se os cinco policiais serão indiciados pela morte de três rapazes. Essa mãe, apesar de sofrer com o medo, é um exemplo de resistência, e foi a fundo, pois o resto foi arquivado.

A investigação no MP ficou dentro dessa linha, como eu pedi. Mas a gente viu também que o policial que conduz o boletim de ocorrência mente. E, quando a mãe chega na delegacia dizendo que quem matou o filho dela foram os policiais, eles mudam a própria versão do boletim de ocorrência deles. Ou seja, há várias contradições nessa história que nós não engolimos. Parece que tinha uma ordem para nada ser investigado nem julgado, e a verdade não ser exposta. Eu tenho certeza que se os Crimes de Maio tivessem acarretados em punição não veríamos esta quantidade de jovens mortos nesses seis anos. Deu certo o modus operandi que eles usaram na época e eles usam até hoje.
In the case of my son I went back to ask for an investigation. I was wondering what cars they were working on the night of that day, names of officers, what course they did, what kind of weapons they used, how many cartridges were used. Research in the MP was within that line of questioning, as I asked. But we also saw that the officer leading the police report minded. And when the mother arrives at the station saying that whoever killed her son was part of the police, they change their own version of the police report them. As mães são muito guerreiras. Eu fiquei na cama de hospital porque eu não aceitava a morte de meu filho, e não aceito até hoje. É muito difícil ver um filho trabalhador, honesto - mas eu sempre digo, mesmo que não fosse - pra defender um miserável salario mínimo e a noite ser executado. Não entra na minha cabeça. Caí na depressão no começo. E eu vejo meu filho até o dia de hoje, não é miragem. Eu vi ele me tirar da cama e ele me pegou com tanta força que eu fiquei com a marca dos dedos dele no braço. 
Mothers are very warlike. I was sick in the hospital because I did not accept the death of my son, and cannot accept it today. It is very difficult to see a child worker, honestly - but I always say, even if not - to defend a miserable minimum wage and the night run. (**not sure how to translate this sentence**) I just can't get this into my head. I fell into depression in the beginning. And I see my son until the present day, it is not a mirage. I saw him take me out of bed and he held me so hard that I got the mark of his fingers on the arm.

Ele falou que me queria ver lutando. Quando ele fez isso eu não deitei mais, só pra dormir mesmo. Fiquei ajudando os outros pacientes e a médica me deu alta. No outro dia fui à caça das outras mães, pois vi a semelhança da causa da morte em vários os casos. Fui atrás da Nalva mãe de um balconista que estava no décimo dia de ferias quando foi assassinado. Falei pra ela: vamos pra luta. Fomos atrás da Vera. Aí ela falou que conhecia alguém próximo da mãe da Ana Paula, a gravida que foi assassinada também. 
He said he wanted to see me struggling. When he did this I could not lay still anymore. I do not do so anymore, even just to sleep. I was helping other patients and the doctor gave me high. The other day I was looking for the other mothers, because I saw the similarity of the cause of death in several cases. I followed the Nalva mother of a clerk who was on the tenth day of his vacation when he was assassinated. I told her, let's go fight. We were behind Vera. Then she said she knew someone close to the mother of Ana Paula, who was murdered and pregnant too.

CM - Receberam algum tipo de apoio? / CM - received some support?

Batemos em várias portas. Fomos atrás pra provar a boa conduta dos meninos. Um promotor do MP nos disse: a justiça da terra não funciona, só a divina. Todos diziam para tomarmos cuidado com a policia. Mas não aceitamos. Aí fomos eu, Vera e Nalva a São Paulo. Eu nunca tinha ido. Fui pra Ouvidoria da PM, contamos tudo que sabíamos, aí encaminharam a gente pro Conselho Estadual de Defesa dos Direitos da Pessoa Humana (Condepe). Chegou lá encontramos a Rose Nogueira e o Luiz Dantas, que virou ouvidor da polícia depois. Ela nos deu o livro “Crimes de maio”. E só aí tivemos a noção o que foi o massacre que teve em maio. Só depois de quase um ano percebemos a dimensão do que tinha acontecido, e que não eram só nossos filhos.

Fomos depois pro Conselho Regional de Medicina que fez um levantamento das mortes. Cobramos as autoridades e ninguém nos falou nada. Foi uma decepção. Aí falamos: agora precisamos mostrar a garra e ir à luta. Soubemos que o caso da Ana Paula foi arquivado já em 2006. Ela estava grávida de 9 meses e foi morta junto com o marido. Vimos que os casos foram todos iguais, e que tinha sido a polícia mesmo.

Eu soube da morte dele pelo rádio, aí liguei pra esse policial, e ele me perguntou na cara de pau quem foi que matou. A gente sabe que funciona assim, quando morre gente, eles vão lá ver. Ele sabia que meu filho tinha morrido e não me avisou.

A police officer's family said that I was supposed to warn people well in the May 15 morning, that whoever was in the street was the enemy of the police. I never imagined that that night they would kill my son. I knew of his death on the radio, then phoned the police, and he asked the guy who did the killing. We know what works well when people die, they go there to see. He knew my son had died and did not tell me.

CM - As mortes foram totalmente aleatórias? / CM - The deaths were totally random?

Tudo aleatório. No dia em que ele morreu o rádio disse que tinham 16 corpos no Instituto Médico Legal jogados no chão. Era ano de eleição e o governo tinha que dar uma resposta pro país, mostrando que tinha controle da situação. Ele respondeu à altura, matando nossos filhos.

Temos que extirpar essa polícia assassina de São Paulo. O governo do estado de SP não investe no ser humano, só em armamento e viatura. Só pra oprimir, porque segurança que é bom, nada. Nós pagamos a bala que mata nossos filhos, pagamos a arma que mata nossos filhos, os algozes que matam nossos filhos e os mandantes dos crimes dos nossos filhos.
Hygiene is poverty. They know that does not give anything for them because the poor have no access to justice. Witnesses are always threatened. We have a security policy of extermination. We have to uproot this murderous police in Sao Paulo. The state government does not invest SP in humans, only weapons and vehicle. Just to oppress, because security is good, nothing. E ninguém toma providência. O governo federal diz que o estadual tem autonomia, mas o estadual não pode ter autonomia de declarar a pena de morte da população pobre, negra da periferia. A ditadura não acabou. Só mudou o inimigo do Estado, que não é mais o inimigo político, mas o pobre e o negro. O capitalismo mata na bala, na falta de educação, de saúde e de moradia. A nossa Constituição não vale de nada pro pobre. Este só tem deveres. Direito é só pros ricos.

Não vejo eles como organização, e sim como uns desorganizados. Senão estariam fora dos presídios. O verdadeiro crime organizado é o Estado.
I see many young people without any structure, living in inhumane chains. The PCC was created by the State based on corruption. I do not see them as an organization, but as disorganized. Otherwise they would be out of prison. The real crime is the state.

CM - O que acha do registro dos homicídios por policiais como “resistência seguida de morte”? / CM - What do you think the record of killings by police as "resistance followed by death"?

A gente entrou numa campanha pelo fim do registro dessas mortes como “resistência seguida de morte”. É uma prática abusiva pra matar e evitar investigações. Nos Crimes de Maio são 84 com tiros na mão e tiros na nuca, que são sinais de defesa. Isso está no Plano Nacional de Direitos Humanos (PNDH-3) e nós clamamos que saia do papel. Que seja registrada como homicídio para que tenha investigação.
We went on a campaign to end the registration of these deaths as "resistance followed by death." It is an abuse to kill and avoid investigations.The Crimes in May consisted of 84 shot in the hand and shot in the neck, which are signs of defense.
