Além da dele, cerca de 10 casas da comunidade Tapeba Sobradinho II foram derrubadas por conta de uma ordem judicial para reintegração de posse. Gilmar vivia na casa há um ano e meio, junto da mulher, grávida de oito meses, e da filha. “Pelo menos esperaram a gente tirar as nossas coisas”, ele conta.

A ordem judicial foi expedida pelo juiz José Coutinho Tomaz Filho, da 3ª Vara Cível do Fórum de Caucaia, na Região Metropolitana. De acordo com o coordenador Regional da FUNAI-Fundação Nacional do Índio, Paulo Fernando Barbosa da Silva, o juiz não poderia mandar a ordem: “Aquela terra já foi delimitada e identificada pela FUNAI e estava esperando só o relatório para fazer a demarcação. Só a Justiça Federal podia interferir lá”, afirmou.

Segundo Paulo Fernando, a terra está em estudo para ficar sob posse da União. A previsão é de que a análise fosse publicada em março, mas ainda não foi concluída. “A FUNAI já mandou ofício ao Ministério Público Federal pedindo providências sobre o que aconteceu”, completou. O território da comunidade, onde vivem 25 famílias, tem cerca de quatro mil hectares.

Valdeci da Silva não estava em casa quando a ordem judicial chegou. A mulher, Antonizete Soares, diz que mal conseguiu avisar ao marido. “Eu fiquei tão nervosa que não consegui ligar. Se tivessem nos avisado antes, a gente teria saído, mas só disseram que a terra tinha dono e nos mandaram sair”, contou ela. A família morava no local desde dezembro. O drama, depois da demolição, já era outro: “Agora eu não sei para onde vou, não tenho nem onde dormir”.

Comunidade foi pega de surpresa

“O Ministério Público vai determinar que a FUNAI alugue residências, e nós vamos dar toda assistência às famílias”, prometeu Paulo Fernando. De acordo com ele, já estava sendo montada a estrutura de água e energia para a comunidade. “Isso é uma falta de respeito com quem mais precisa. Lá já existem escolas e plantações, a FUNAI vai ficar com a terra, sem dúvidas”, ressaltou.

Para pressionar a finalização do estudo a respeito da terra e garantir a demarcação, um grupo de cerca de 200 índios interditou a BR 222. Foram usadas pedras, troncos de árvores e um trator para criar uma barreira que impedia a passagem dos carros.

 A Comunidade Sobradinho II fica às margens da BR 020, em Caucaia. Com cerca de quatro mil hectares, é reivindicada pela FUNAI e já possui escolas e plantações. Segundo a Justiça de Caucaia, porém, a terra pertence a um proprietário particular. Mais de 25 famílias moram no local.
