O Centro de Monitoramento de Agrocombustíveis (CMA) da ONG Repórter Brasil lançou nesta quarta-feira, 24, o relatório "Em terras alheias – a produção de soja e cana em áreas Guarani no Mato Grosso do Sul" (http://www.reporterbrasil.org.br/documentos/emterrasalheias.pdf. Com base em dados de órgãos públicos e entrevistas in loco nas aldeias, o trabalho buscou mapear a incidência de produtores destas commodities em seis áreas no Estado: as Terras Indígenas (TIs) Jatayvary, Guyraroká, Takuara e Panambi-Lagoa Rica (já declaradas pela Funai), e as áreas Laranjeira Nhanderu e Guaiviry (em estudo pela Funai). 

The Centro de Monitoramento de Agrocombustíveis of the NGO Repórter Brasil launched a report on Wednesday the 24th titled "In the land of others - the production of soybeans and sugarcane areas in Guarani in Mato Grosso do Sul" (http://www.reporterbrasil.org.br/documentos/emterrasalheias.pdf). Based on the data obtained from government agencies and from on-site interviews in the villages, the study sought to map the incidence of producers of these commodities in six areas in the state: Indigenous Lands (TIs) Jatayvary, Guyraroká, Takuara and Panambi-Lagoa Rica (already declared by Funai), and the Laranjeira Nhanderu and Guaiviry areas and Nhanderu Guaiviry (under study by Funai).

A divulgação do relatório acontece no momento em que os conflitos de terra entre indígenas e produtores rurais têm se acirrado no Mato Grosso do Sul. No período entre a realização das pesquisas, em julho deste ano, e sua divulgação, várias retomadas de terra pelos Guarani-kaiowá levaram a novos confrontos e reações extremadas por parte de fazendeiros, com ataques à bala a acampamentos e ameaças explícitas, como nos casos das áreas de Arroio Korá e Potrero Guasu, ambas em Paranhos.

The report's release comes as the land conflicts between indigenous peoples and farmers have worsened in Mato Grosso do Sul. This took place in the period of the completion of the research, in July this year, and the disclosure of the report. Various land reclamations by the Guarani-Kaiowa led to further clashes and extreme reactions by farmers, with attacks on the camps using bullets and explicit threats. An example of this were the areas of Arroio Korá and Potrero Guasu, both in Paranhos.

Em agosto, cerca de 700 kaiowá retomaram parte da área de Arroio Korá, cuja homologação ocorreu em 2009, mas foi questionada na Justiça pelos fazendeiros (a decisão final sobre o processo está parada no Supremo Tribunal Federal). Logo após a retomada, o acampamento indígena foi atacado por diversas vezes por pistoleiros, sendo que o fazendeiro Luis Carlos da Silva Vieira, conhecido como “Lenço Preto”, declarou, em entrevista gravada em vídeo, que lideraria "uma guerra contra os indígenas". Em outubro, a retomada da terra Potrero Guasu também sofreu ataque de pistoleiros.

Laranjeira Nhanderu e Guaiviry, as duas áreas ainda não reconhecidas pela Funai abordadas no relatório, são um exemplo da danosa morosidade do governo em resolver a situação conflituosa e finalizar os processos de demarcação das terras indígenas. Guaiviry foi palco, no final do ano passado, de um dos mais brutais casos de assassinato de uma liderança indígena, o cacique Nizio Gomes. Em julho, 18 acusados de participação no crime foram presos pela Policia Federal (dados sobre os fazendeiros denunciados foram disponibilizados no relatório).

Laranjeira Nhanderu and Guaiviry, the two areas that have not yet been recognized by Funai are addressed in the report and are an example of harmful government delays in resolving the conflict situation andthe finalization of the process of the demarcation of indigenous lands. At the end of the last year Guaiviry was the scene of one of the most brutal cases of murder of an indigenous leader, Chief Nizio Gomes. On July 18th those accused of involvement in the crime were arrested by Federal Police (data on farmers reported were provided in the report).

Por outro lado, interpretações desencontradas da Justiça acerca dos direitos constitucionais dos Guarani-kaiowá também têm contribuído para o clima de extrema insegurança entre os indígenas. No dia 5 de outubro, o Tribunal Regional da 3ª Região de São Paulo publicou um acórdão derrubando uma decisão anterior que garantia a posse indígena da aldeia de Paso Piraju, em Dourados, desde 2004 (Funai e MPF entraram com recurso, e a execução do despejo só se daria após a apreciação do mesmo).


Moreover, disparate interpretations of Justice regarding the constitutional rights of the Guarani-Kaiowa have also contributed to the climate of extreme insecurity among Indians. On the 5th of October, the Regional Court of the 3rd Region of São Paulo issued a ruling overturning a previous decision that guaranteed Indian possession of the village of Paso Piraju in Dourados that had been in place since 2004 (Funai and MPF filed an appeal, and execution of the eviction would only take place after an assessment thereof).

Em 29 de setembro, a Justiça Federal de Navirai também ordenou o despejo da comunidade de Pyelito kue/Mbrakay, em Iguatemi, o que levou os indígenas a anunciar, em carta, a intenção de morrer na área caso a expulsão ocorra. “Sabemos que não temos mais chance em sobreviver dignamente aqui em nosso território antigo, já sofremos muito e estamos todos massacrados e morrendo em ritmo acelerado. Sabemos que seremos expulsos daqui da margem do rio pela Justiça, porém não vamos sair da margem do rio. Como um povo nativo e indígena histórico, decidimos meramente em sermos mortos coletivamente aqui. Não temos outra opção esta é a nossa última decisão unânime diante do despacho da Justiça Federal de Navirai-MS”.

O reconhecimento legal, e também pelo setor produtivo, do direito das populações Guarani-kaiowá a terras ancestralmente por elas ocupadas, das quais foram expulsas tanto pelas políticas públicas do governo quanto pelo avanço do agronegócio, é essencial para a sobrevivência destas populações. Neste sentido, o relatório apresenta breves históricos dos processos de retomada das áreas estudadas, aponta os impactos da produção de commodities e lista propriedades privadas e produtores no interior desses territórios.

The legal recognition, and also by the productive sector, the right of the people of the Guarani-Kaiowa to occupy ancestral lands, both of which were driven out by government policies and by the advance of agribusiness, is essential for the survival of these populations. In this sense, the report presents an overview of the brief historical processes of recovery of the areas studied, pointing to the impacts of commodity production and private property lists and producers within these territories.

O mapeamento feito pela ONG Repórter Brasil ajuda na discussão sobre a corresponsabilidade da cadeia produtiva da soja e da cana nos problemas decorrentes da ocupação das terras Guarani-kaiowá pelo agronegócio. É fato que duas usinas no Estado, São Fernando e Raízen já se comprometeram a não mais comprar a produção de cana em áreas indígenas. Tal medida de responsabilidade socioambiental empresarial é um primeiro passo no reconhecimento dos direitos indígenas pelo setor produtivo, fazendo-se urgente sua adoção pelas demais usinas sucroalcooleiras, usinas de biodiesel, traders e cerealistas.

The mapping which was done by the NGO Repórter Brasil helps with the discussion about the responsibility of the production chain of soybean and sugarcane regarding the problems that arise from the occupation of Guarani-Kaiowa land by agribusiness . It is a fact that two plants in the San Fernando and Raizen states have already pledged to buy no more cane from production in indigenous areas. This measure of corporate environmental responsibility is a first step in recognizing indigenous rights by the productive sector, becoming urgent adoption by other sugarcane plants, biodiesel plants, traders and cereal producers.
