Numa grande vitória dos moradores do Pinheirinho, uma
decisão do Tribunal Regional Federal – 3ª. Região suspendeu, nesta sexta-feira,
dia 20, a ordem de reintegração de posse da Ocupação, em São José dos Campos. A
decisão foi tomada pelo desembargador federal Antonio Cedenho, da 5ª Turma do
TRF.
O desembargador determinou que a União passe a
integrar o processo por conta do interesse do Governo Federal na área. Assim, o
processo será deslocado da Justiça Estadual (da juíza Márcia Loureiro) para a
Justiça Federal.
Não cabe recurso às instâncias superiores, enquanto a
turma de desembargadores do Tribunal não analisar a decisão.
A decisão revalida a liminar concedida, dia 17, pela
juíza substituta Roberta Monza Chiari momentos antes da execução da
reintegração de posse pela Tropa de Choque da Polícia Militar. Nessa liminar, a
juíza Roberta Chiari reconhece o interesse da União no caso e cita ofício do
Ministério da Cidade pedindo adiamento da reintegração.
A medida é em resposta ao Agravo de Instrumento
impetrado pelos advogados dos moradores, em que pediam o reconhecimento do
interesse da União no caso e que fosse deferida uma liminar impedindo a
execução da ordem de despejo.
“Hoje é dia de festa na periferia. Continuamos insistindo que a solução
definitiva não está no Judiciário, mas no Executivo. O prefeito Eduardo Cury
tem a obrigação de negociar junto aos governos federal e estadual para que
possamos encontrar uma saída pacífica que beneficie os moradores do Pinheirinho”,
afirma o advogado dos moradores Antonio Donizete Ferreira.

In a major victory for the residents of Pinheirinho a decision of the Federal Court - 3rd. Region suspended on Friday, 20 days, the order of repossession/eviction of the Occupation, in Sao Jose dos Campos. The decision was taken by the federal judge Antonio Cedenho, the 5th Group of the TRF.
The judge ruled that the Union will join the process on behalf of the Federal Government's interest in the area. Thus, the process will be moved from state court (the judge Marcia Loureiro) to the Federal Court.
No appeal to higher authorities was permitted, while the class of justices of the Court did not review the decision.
The decision restores to the injunction granted 17 days by Judge Roberta substitute Monza Chiari moments before the execution of repossession/eviction by the Military Police. In this preliminary injunction, Judge Robert Chiari recognizes the Union's interest in the case, citing the Ministry of City office requesting postponement of reinstatement.
The move is in response to the bill of review filed by lawyers for the residents incalling for the recognition of the Union's interest in the case and upheld an injunctionthat would prevent the execution of the eviction order.
"Today is a day of celebration. We continue to insist that the ultimate solution is not in the judiciary but the executive. Mayor Eduardo Cury has the obligation to negotiate with federal and state governments so that we can find a peaceful solution that benefits the residents of Pinheirinho, "said lawyer Antonioresidents Donizete Ferreira.
