Às vésperas da comemoração do Dia do Índio, o presidente da Câmara dos Deputados Henrique Eduardo Alves (PMDB-RN) criou ontem (11/4) uma Comissão Especial para discutir a PEC 215/2000, cujo objetivo é atribuir competência exclusiva ao Congresso Nacional para a demarcação de terras indígenas, incluindo a ratificação das terras já homologadas. Veja aqui!

On the eve of the commemoration of the Day of the Indian, the president of the Chamber of Deputies Henrique Eduardo Alves (PMDB-RN) yesterday created (11/4) a special committee to discuss the PEC 215/2000, which aims to assign exclusive jurisdiction to Congress for the demarcation of indigenous lands, including lands already approved and ratificatied. A atribuição da Comissão Especial é analisar o mérito do projeto do deputado Almir Sá (PPB-RR) e as propostas apensadas a ele. A comissão deve avaliar 11 proposições ao todo, todas com o objetivo de rever as atribuições da União quanto à competência para demarcar Terras Indígenas, como também sobre as atribuições no reconhecimento de territórios quilombolas e a criação de Unidades de Conservação Federais.

The purpose of the Special Committee is to examine the merits of Mr Almir Sa's project (PPB-RR) and proposals appended to it. The committee shall evaluate 11 proposals in total, all with the goal of reviewing tasks regarding the capability of the Union to demarcate indigenous lands, as on assignments in recognizing and creating Federal Conservation Units.

Para os movimentos indígena e indigenista, a PEC - que revê a prerrogativa do Executivo para a criação, demarcação e homologação de áreas indígenas, quilombolas e de unidades de preservação ambiental - coloca em risco a integridade física dessas comunidades. A aprovação do projeto significará um grande retrocesso, tanto nos processos de regularização de áreas protegidas, como na segurança dos direitos territoriais dos povos indígenas.

For indigenous and indigenous movements, the PEC's revising the right of the executive to the create, approve and demarcate indigenous areas, maroons environmental conservation units and endangers the physical integrity of these communities. The approval of the project will mean a big step backwards, both in regularizing protected areas, such as the security of the land and rights of indigenous peoples.

A criação da Comissão Especial ocorreu após a passagem da PEC pela Comissão de Constituição e Justiça da Câmara, onde foi aprovada mesmo tendo o teor de sua constitucionalidade questionado.

The creation of the Special Committee occurred after the passage of the PEC Committee on the Constitution and the House of Justice, where it was approved even though the content questioned its constitutionality.

Em nota técnica, a Associação Juízes para a Democracia (AJD) lembra que a exigência de autorização ou ratificação da demarcação das terras indígenas pelo Congresso Nacional, além de contradizer o princípio da separação dos poderes, insculpido no artigo 2º da Constituição Federal, viola a Convenção nº 169 sobre Povos Indígenas e Tribais em Países Independentes da Organização Internacional do Trabalho (OIT, 1989), de que o Brasil é signatário. Leia aqui a íntegra da nota da AJD!

On a technical note, the Association of Judges for Democracy (AJD) recalls that the requirement for authorization or ratification of the demarcation of indigenous lands by Congress, besides contradicting the principle of separation of powers in Article 2 of the Constitution, violates the Convention No. 169 on Indigenous and Tribal Peoples in Independent Countries of the International Labour Organisation (ILO, 1989), to which Brazil is a signatory.
