Está ocorrendo situação da maior gravidade na Reserva Indígena Caramuru Catarina-Paraguaçu. Apesar de o Supremo Tribunal Federal (STF) já haver julgado nulos os títulos ilegais de terras que fazendeiros possuíam dentro dessa terra indígena, e de esses fazendeiros já haverem sido retirados da área, a Justiça tem acatado pedidos de reintegração de posse desses mesmos fazendeiros, para que eles reocupem a reserva indígena. Liminares já foram emitidas e a Polícia Federal já as está cumprindo retirando os índios das áreas. 

A most serious sitiation is taking place on the Indian Reservation Caramuru-Paraguaçu Catarina. Although the Supreme Court (STF) had already judged null void land titles held by farmers within this indigenous land, and these farmers having already been removed from the area, the court has complied with requests for repossession of these lands by those farmers. They have since then reoccupied the land on the Indian reservation. Injunctions have been issued and the Federal Police are now removing the Indians from those areas.

Os Pataxó Hã-Hã-Hãe estão surpresos e perplexos com essa situação, pois tudo levava a crer já estar resolvida. A situação pode voltar a ficar extremamente perigosa para essa comunidade indígena, e novos conflitos com os fazendeiros poderão voltar a ocorrer.

The Pataxó Hã-Hã-Hãe are surprised and perplexed by this situation because they had all been led to believe that the situation had been resolved. The situation can again be extremely dangerous for the indigenous community, and new conflicts with farmers may arise.

Em meu entender, este tipo de decisão, mesmo que liminar, cria insegurança jurídica séria para as Terras Indígenas. É inadmissível que sejam expedidas liminares de reintegração de posse a favor de fazendeiros não índios em uma terra indígena reconhecida pelo Estado, e ratificada pelo tribunal maior de nossa república!

In my view, this kind of decision, even though preliminary, creates serious legal uncertainty for Indigenous Lands. It is unacceptable that injunctions are issued repossessing land in favor of non-Indian farmers on indigenous land that has been recognized by the state, and ratified by the highest court of our republic!

É necessário que isto seja amplamente divulgado!
